Terms of Service

Welcome to Smoothie Studio early access. These Terms of Service govern your access to and use of the service. By using Smoothie Studio, you confirm that you accept these Terms and agree to follow them.

If you do not agree to these Terms, you should not access or use Smoothie Studio.

Smoothie Studio is provided by QWIRKLABS SRL, an Italian limited liability company (societa a responsabilita limitata), with registered office at Via Fratelli Lumiere 2, 20127 Milano (MI), Italy.

Smoothie Studio is currently in early access. We are actively developing it, so features, availability, interfaces, and functionality may change at any time.

Early access is provided to let users explore, test, and share feedback on Smoothie Studio while it is being developed. QWIRKLABS may add, remove, suspend, or modify parts of the service during this period.

To access Smoothie Studio, you may need to sign in through supported providers, such as Google or GitHub. You are responsible for maintaining the security of the accounts you use to access Smoothie Studio.

During early access, QWIRKLABS may approve, limit, suspend, or revoke access to Smoothie Studio at its discretion, including to protect the service, manage capacity, or address suspected misuse.

Use Smoothie Studio lawfully, responsibly, and with respect for applicable laws and third-party rights.

• You must not attempt to compromise, bypass, or test the security of Smoothie Studio without authorization.
• You must not access or attempt to access accounts, systems, data, or areas of the service without authorization.
• You must not submit malicious code, malware, or other content intended to damage or disrupt the service.
• You must not overload, interfere with, degrade, or disrupt Smoothie Studio or related infrastructure.
• You must not reverse engineer Smoothie Studio where doing so is prohibited by applicable law.

You keep ownership of the content, prompts, inputs, instructions, files, and other materials that you submit to Smoothie Studio, where applicable.

To provide the service, you grant QWIRKLABS a limited right to use that content only as necessary to operate, maintain, secure, troubleshoot, and provide Smoothie Studio to you. QWIRKLABS does not claim ownership of your content. Depending on the AI features used, your content may be processed by third-party AI providers as described in our Privacy Policy.

Smoothie Studio may include AI-powered features. AI-generated outputs can be inaccurate, incomplete, unexpected, or unsuitable for your intended purpose.

You are responsible for reviewing outputs before relying on them, sharing them, or using them in your work.

As an early access product, Smoothie Studio is continuously evolving and may experience changes, limitations, interruptions, or unexpected behavior during development. QWIRKLABS does not guarantee uninterrupted, error-free, or permanent availability.

Smoothie Studio, including its software, interfaces, designs, branding, documentation, and related materials, is owned by QWIRKLABS SRL or its licensors.

Subject to these Terms, QWIRKLABS grants you a limited, non-exclusive, non-transferable right to access and use Smoothie Studio during your access period.

Smoothie Studio is provided on an as available basis during early access. To the maximum extent permitted by applicable law, QWIRKLABS disclaims warranties that are not expressly stated in these Terms.

To the maximum extent permitted by applicable law, QWIRKLABS will not be liable for indirect, incidental, special, consequential, or similar damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of Smoothie Studio.

Nothing in these Terms limits liability that cannot be limited under applicable mandatory law, including mandatory consumer protection rights where they apply.

You can stop using Smoothie Studio at any time. QWIRKLABS may suspend or end your access if you violate these Terms, if access is revoked during early access, or if QWIRKLABS discontinues the early access program.

After termination, your right to use Smoothie Studio ends. Terms that by their nature should continue to apply, including intellectual property, user content permissions already needed to operate the service, disclaimers, limitation of liability, governing law, and contact provisions, will continue to apply.

QWIRKLABS may update these Terms as Smoothie Studio evolves or as legal, operational, or security requirements change. The updated version will be published on this page with a new last-updated date.

Your continued use of Smoothie Studio after updated Terms are published means that you accept the updated Terms.

These Terms are governed by Italian law. Subject to any mandatory applicable law that provides otherwise, the courts of Milan, Italy will have jurisdiction over disputes relating to these Terms or Smoothie Studio.

If you are a consumer or are located in a jurisdiction where mandatory laws grant you additional rights or a different forum, those mandatory rules may override this clause.
